How Disputes are Resolved
To the extent permitted by law, both Myridius and you agree to submit any and all controversies, claims and/or disputes that may arise between you and Myridius to expedited binding arbitration.
YOU APPRECIATE AND UNDERSTAND THAT OTHER OPTIONS SUCH AS FEDERAL AND STATE ADMINISTRATIVE AND JUDICIAL REMEDIES MAY EXIST; THAT BY CONSENT THOSE REMEDIES ARE FOREVER PRECLUDED; AND THAT REGARDLESS OF THE NATURE OF THE COMPLAINT, YOU AGREE THAT THE COMPLAINT CAN ONLY BE RESOLVED THROUGH BINDING ARBITRATION. YOU WAIVE THE RIGHT TO A TRIAL BY JURY.
The binding arbitration described in this paragraph shall be conducted by a mutually agreed upon third party arbitrator, at a mutually agreed upon location and subject to mutually agreed upon rules. If the parties cannot reach agreement on an arbitrator, location or rules, the arbitration shall be administered by JAMS, a third party provider of dispute resolutions services, in Myridius' offices located in Iselin, NJ pursuant to the Federal Arbitration Act and utilizing the applicable JAMS rules.
Either RCG or you may request arbitration. Requests to arbitrate must be filed with the other party and, if JAMS is that agreed upon arbitrator, with JAMS within ninety (90) calendar days after the claim or dispute arises or the act or acts as to which arbitration is brought occur. If a party fails to file a request for arbitration with the other party within ninety (90) calendar days after the claim or dispute arises, that claim or dispute will be conclusively resolved against that party even if there is an applicable statute of limitations that may have given the party more time. Any judgment upon the award rendered by the arbitrator may be enforced in any court of competent jurisdiction. The costs of such arbitration shall be borne equally by the parties with each party also paying for its own attorneys’ fees and any costs associated with presenting its proof.
